  2. I think I may have found part of a key to the mystery why CDU has all but Smithville labeled as an IMPORT. The UPC for Smithville starts out 0946 3 all others are 50999 5. The codes don't mean much to me though I was under the impression that the beginning numbers identified the manufacturer in some way. Great music by the way. First time hearing all of these for me.
  3. I posted this in the Borders Coupon thread a couple of weeks ago. This is what is happening at the south location in my town. I stopped by the north location a few days later and saw a similar sight. I too remember spending hours, walking through the Jazz setion. Now I can peruse the entire jazz selection in a matter of minutes....while standing in place...

  6. I went to my south Borders location today and was shocked. The entire music section had been shrunk, not just the jazz. This is truly the beginning middle of the end... I hear they sent back 17,000 titles to the distributor (books, DVD, and music). The entire music section fits into what the jazz selection looked like 2 years ago.

  12. You could always consult Nick Hornby's rules for making a mix-tape from High Fidelity.... Rob: To me, making a tape is like writing a letter. There's a lot of erasing and rethinking and starting again. A good compilation tape, like breaking up, is hard to do. You've got to kick off with a corker, to hold the attention (I started with "Got to Get You Off My Mind," but then realized that she might not get any further than track one, side one if I delivered what she wanted straightaway, so I buried it in the middle of side two), and then you've got to up it a notch, or cool it a notch, and you can't have white music and black music together, unless the white music sounds like black music, and you can't have two tracks by the same artist side by side, unless you've done the whole thing in pairs and...oh, there are loads of rules.

  15. Blue Note 70th Anniversary All-Stars - To celebrate Blue Note’s 70th anniversary in 2009 we have assembled a truly all star band that will record at the end of May. UPDATE: Concord (via Telarc International) sent the missing CD booklet to me. I immediately followed my original phone call with an email and that apparently did the trick. Thanks Concord. You made it right. PS I was able to contact CD Universe to stop the re-shipment.

Logo Spat Pits Apple vs Big Apple At Core of Dispute Are Similar Logos By BRYAN GARDINER April 4, 2008 — The Big Apple has a new logo, and Apple says: Drop dead. At issue is the emblem for New York City's GreeNYC campaign, which has started to appear around the city on bus shelters, hybrid gasoline-electric taxicabs and even Whole Foods shopping bags. The GreeNYC logo shows a stylized apple with a stalk and a leaf. It bears a resemblance to Apple's famous logo -- a resemblance Apple says infringes on its trademark. The city has applied for a trademark on the logo, but Apple has filed a formal opposition (.pdf) obtained by Wired.com. The Cupertino, California, company calls for the trademark to be denied, claiming the city's logo will confuse people and "seriously injure the reputation which [Apple] has established for its goods and services." New York says: Getdafugoutaheya. "The city believes that Apple's claims have no merit and that no consumer is likely to be confused," says Gerald Singleton, the intellectual-property lawyer representing the Big Apple. "This well-known city is using its new design in a variety of contexts that have absolutely nothing to do with Apple Inc." Apple, of course, is no stranger to trademark disputes, but has typically been on the receiving end of infringement claims. Apple Corps, holder of the Beatles' business interests, battled the company for years over its trademark. That legal spat was finally resolved last year, with Apple walking away with the entire brand and an apparent agreement to license certain trademarks back to Apple Corps. Cisco Systems also filed suit over Apple's use of the iPhone trademark last year, and both companies finally agreed to share the iPhone name. "When you talk about trademark infringement, the key issue is likelihood of confusion," says Beth Goldman, an attorney at Heller Ehrman and head of the firm's San Francisco trademark group. Trademark protection extends to sight, sound and meaning, Goldman says, and if a company can prove there's confusion over such matters, it may very well have a case. In the case of very famous marks or logos, there's also the issue of dilution, she says, when someone else uses it in a manner that blurs or tarnishes the trademark. Dilution is harder to prove with a logo, Goldman says, as it's not usually descriptive of a product. Nevertheless, the U.S. Patent and Trademark Office will consider such arguments. NYC & Company, the nonprofit responsible for the city's official tourism website, applied for a trademark on the new logo on May 14, 2007. The company and its lawyers have filed a counterclaim asking that Apple's trademark registration for its apple logo be canceled. Apple did not immediately respond to Wired.com's requests for comment. The GreeNYC campaign is intended to promote "environmentally friendly policies and practices" and "economically sustainable growth." The next step in the Apple-New York City trademark scuffle, according to trademark lawyers, will be to commission a series of independent surveys -- what are known as mall-stop surveys -- to gauge people's reaction to the new logo, in order to see whether Apple's opposition holds any merit. "The ultimate arbiter is the consumer," Goldman says. Singleton says the dispute will play out over the next six to nine months, before a final decision is made by the Trademark Trial and Appeal Board of the patent office. Source

Dan- Go grab that loaf of Wonder Bread, that 2-liter of Pepsi, or a box of any General Mills cereal [i confirmed this one ] and I'll bet you find a "Guarantee" from the manufacturer promising a refund if not completely satisfied. The ones I find amusing are those instructing the consumer to "simply return the unused portion" ...like that doesn't result in some pretty nasty messes for your mail carrier.... Anyway I completely understand the reasons why it would be difficult for Concord to take care of the problem, but that's what separates the good from the great.
  23. I ordered 3 CDs from CDUniverse (2 RVGs & 1 Keepnews, all Concord) Bags Meets Wes! arrived still factory sealed but without a CD booklet inside. The post card to get on the Concord mailing list was there but no booklet. I called Concord first, thinking that by going directly to the source I might have better luck. I spoke with a real person in just a matter of minutes so I will give them credit for that. However, I was told that because I didn't order from the Concord website that there was nothing that they could do for me. The problem was clearly at the point of manufacture, not anything that the retailer did wrong. I would have thought that Concord would step up and offer a solution. I was wrong. ------------ I called CDUniverse, again I got a real person in a matter of minutes - so shocking in the automated phone world of today. I told the customer service representative about the problem and she immediately scheduled a replacement shipment of the item. She even told me not to bother to send the other one back - though I plan to as a matter of principle. Maybe I am being unfair. Admittedly, the transaction was with CDUniverse and not with Concord, but this was Concord's product, Concord's mistake. Although my issue was satisfactorily resolved I am a little disappointed that Concord didn't step up and take care of the problem.
