Music Biz to Give File Sharers Amnesty

The Recording Industry Assn. of America plans to announce an amnesty program this week that will let individual online copyright infringers off the hook if they change their ways, sources say.

The amnesty program would apply only to alleged infringers who have not been sued by the music industry trade group or identified by Internet service providers as a result of the trade group's subpoena process. Alleged commercial pirates will not receive amnesty.

According to sources, the RIAA will not pursue legal action if infringers delete all unauthorized music files from their computers, destroy all copies (including CD-Rs) and promise not to upload such material in the future. Each infringing household member will have to send a completed, notarized amnesty form to the RIAA, with a copy of a photo ID. Those who renege on their promise will be subject to charges of willful copyright infringement.

The amnesty program will be revealed at about the same time the RIAA is expected to announce the filing of "several hundred" infringement suits.

The RIAA had no comment.

Actually, the last time the wife & I had drinks with Mitch and his wife down in Miami immediately following the 2002 elections, he was quite convinced that he'd launch his own PR outfit and I was as surprised as the next guy when he suddenly parachuted into this position. I really don't follow their issues as closely as I should but perhaps I'd better start keeping up to speed so that (after they put me on retainer) I can pull some strings for Organissimo the next time they get their ass in a sling. Then again, maybe I'll forward this thread to his attention and we'll see if he can't play the Fist of Doom routine on Use3D just for kicks.

If they had their way they would be able to. They tried to sneak a bill into the Patriot Act (that lump of garbage) that would've given them the right to hack into your computer and delete files without you knowing and without you being able to do anything about it.

Say they deleted the wrong file... or just wiped your hard drive clean. You'd have no recourse under the law.

Thankfully someone noticed this and it got shitcanned. But they're still trying.

And Weizy, if Organissimo ever got it's ass in a sling (whatever that means) the LAST place I'd go looking for help is the RIAA.

*2002:

Als beste Künstler werden Madonna, Herbert Grönemeyer, Tom Jones, Cher, und Santana ausgezeichnet. Zu den Top-Hits gehören Westlife mit "Uptown Girl", die No Angels mit "All Cried Out", Kelly Osbourne mit "Papa Don't Preach", Madonna mit "American Pie". Die Musikindustrie erfährt zum ersten Mal nach einer langen Boomzeit einen Umsatzrückgang. Als Hauptursachen macht sie das in Mode gekommene Kopieren von CDs und das Tauschen von Musikdateien im Internet verantwortlich. Um den Kids klar zu machen, daß das Kopieren von Musik letzendlich die Künstler schädigt, startet die Industrie die Kampagne "Copying Music is Killing Music".

*2003:

Der Umsatz der Musikindustrie schrumpft erneut um 50%. Die Trend-Scouts entdecken, daß unter den Jugendlichen 60er- 70er- 80er und 90er-Revivals in sind. Lizenzen gibt es nur noch temporär, es ist nicht mehr möglich, ein Musikstück "für immer" zu erwerben. Dafür werden die "Smart-CD"-Spieler im Bundle mit einem Musik-Abo für einen Euro angeboten.

Als erfolgreichste Künstler werden Herbert Grönemeyer, die Scorpions, Mark Oh, Oli P. und Peter Kraus ausgezeichnet. Mit Hinweis auf die vielen bedrohten Arbeitsplätze setzt die Musik-Lobby ein Gesetz durch, nachdem der Rückruf einmal erteilter Lizenzen möglich ist. Prompt widerruft die Industrie alle bisher erteilten Lizenzen auf nicht kopiergeschützte Tonträger. Damit werden alle älteren CDs und alle LPs illegal, ebenso Plattenspieler und CD-Spieler, die nicht dem "SmartCD" Standard entsprechen. Im Austausch für ihre Original-CDs bietet die Industrie CD-Besitzern eine Einjahreslizenz für die auf der CD vorhandene Musik an. Nach einer erneuten Abmahnwelle der Kanzlei G. aus M. bricht der Tonträgerhandel über eBay zusammen. Auf die Veröffentlichung von Charts und die Auszeichnung von Künstlern wird verzichtet. Zunächst einmal müssen die Lagerbestände an CDs abverkauft werden.

*2008:

Musik wird in Deutschland nur noch im Radio oder bei Konzerten gehört. Das Radio verliert aber an Popularität, seit die Industrie die Sender zwingt, nur noch neueste Produktionen zu spielen und über diese drüberzusprechen, damit das Aufnehmen mit Tapedecks verhindert wird. Konzerte sind fast unbezahlbar geworden, da das gesamte Management von den Eintrittspreisen mitbezahlt werden muß. Dagegen häufen sich die sogenannten "Open Jams", spontane Zusammenschlüsse von Hobby-Musikern, die auf öffentlichen Plätzen mit Gitarre, kleinem Schagzeug, Keyboard, Saxophon etc. Musik spielen und von begeisterten Zuhörern gefeiert werden.

*2009:

Die Musiklobby setzt beim Gesetzgeber das Verbot öffentlicher und privater Performance urheberrechtlich geschützen Materials durch. Musikinstrumente werden mit einer Urheber-Abgabe belegt, da man ja eine Gitarre etwa zum Raub-Abspielen von Stones-Songs mißbrauchen kann. "Making music is killing music" lautet die begleitende Kampagne, die den Leuten Unrechtsbewußtsein beibringen soll.

*2010:

Um Arbeitsplätze bei Musikern zu schützen, wird Musikunterricht rationiert: Es dürfen nur noch so viele Nachwuchsmusiker ausgebildet werden, wie der Markt braucht. Da dieser schneller schrumpft als die Musiker wegsterben, bedeutet das faktisch ein Verbot des Musikunterrichts. Hunderte Musikschulen werden geschlossen.

*2011:

Sarah Connor versucht mit "Terminate Me" einen neuen, nicht gecoverten Song herauszubringen, wird aber dafür von den Anwälten der Musikrechteinhaber verklagt, die es nicht erlauben, daß neue Urheber am kleiner werdenden Kuchen mitverdienen wollen. "Composing music is killing music" heißt das Schlagwort der Inhaber alter Rechte. Sarah Connor gewinnt den Rechtsstreit, wird aber kurz darauf unter mysteriösen Umständen ermordet aufgefunden. Von nun an traut sich niemand mehr, neue Songs zu schreiben.

*2012:

Die Eltern des 6-jährigen Wolfgang Amadeus Moherb, des "Jugend-musiziert"-Siegers, werden zu 150.000 Euro Schadenersatz an die Musikindustrie verurteilt, weil sich herausgestellt hat, daß ihr Kind erst seit eineinhalb Jahren musiziert, also nach dem Inkrafttreten der Unterrichts-Rationierung. Nahezu jede tonliche Äußerung, darunter Motorgeräusche, Trittschall, Türschließgeräusche und gesprochenes Wort, sind unter urheberrechtlichen Schutz gefallen. Eine Tür zumachen darf quasi nur noch, wer nachweisen kann, daß der dabei erzeugte Schall nicht dem von Porsche patentierten ähnelt. First, I want to say file sharing has damaged all of the music biz, large and small. Bob Koester is convinced he has lost at least 10% a year to downloading. For indies, 10% is the difference between losing money and losing more money.

More importantly, file sharing has nurtured a generation of young folk who think music should be free and is their "right".

RIAA is really just a lobby for a few industry giants and have reacted badly to the situation. I have no clue about the proper response but they just hurt their own cause.

Well, in all seriousness for a bit here....Bainwol just took the helm of the organization that was led for years by the very unpleasant Ms. Rosen and we'll have to wait and see what transpires. Please tell me how an org. that is issuing subpoenas and trying to shock/stroke a younger audience into not 'stealing' music, is a slight to the artists?

The problem (well, one of them) is that RIAA--working on behalf of major record companies--admonishing young people has a hollow ring when one considers how the industry has robbed its artists for decades.

I'll grant you that RIAA Rosen was a disaster, and that something definitely needs to be done about illegal downloading, but--based on the organization's history, RIAA is not the answer.

As an attorney I would strongly recommend against anyone taking RIAA up on their "generous offer."

Although RIAA agrees not to sue those who comply with the terms of the amnesty agreement, the agreement would not prevent the artist, publisher, or the label from bringing suit. And the amnesty agreement would be used as evidence of an admission of guilt.

This is a bad deal.
