For those who care, this was all related to the famous Baltimore Terrapins case.

In the days before radio, the Supreme Court ruled that baseball was not interstate commerce.  Sixty years later, everyone knew better, and the basketball people did not enjoy an exemption from anti-trust laws.  It was illegal for the four ABA teams to abandon those not admitted to the NBA.
