I'm assuming Sue is cool with it. They do have that dislaimer on their site.

Would you point me to the disclaimer. I don't think I've ever seen it and I dod wonder about the legality of Wolfgang's Vault.

Go to the home page, then at the bottom of the page under 'concert audio' there is a section called 'about our audio'. Click on that and you will see the following:

The Concert Vault is fully licensed by BMI, ASCAP, and SESAC, and we pay these performance rights organizations every time you listen to a concert. The license fees make their way back to the performers that made the music. Download revenues are also shared with performers and publishers as appropriate. One of our top priorities will always be to make sure that the artists are compensated for their performances.

Whether or not this will satisfy every performer and/or estate is another story.

I'm questioning the order of tenor soloists on the ballad medley. Specifically, I'm wondering if it's Dewey Redman on 'Smoke Gets In Your Eyes' and Eddie Daniels on 'My One And Only Love', rather than the other way around.

The soloists are not announced; I am assuming Milkowski is going by ear. Maybe he consulted with others on this, although I doubt it.

Any thoughts?

I just want to point out payments to BMI, ASCAP and SESAC only cover the composer broadcast/streaming rights, not the performers.

What this actually entails is a matter of speculation. A good test case is whether or not Sue Mingus and the Miles Estate are OK with all this. I find it hard to believe they are not aware of Wolfgang's vault. For all we know, there is already litigation in process.

"As appropriate" probably refers to what was in the contract the artist signed with the promoter for the performance. If the contract gave the promoter the rights to market the performance, then that governs. This is probably the distinction between the concerts Vault merely streams and the concerts they sell. Let's also not forget that record sales are currently in the doldrums. It's possible WV proposes to the performer "we're allowed to stream, but if you allow us to sell, we'll give you a cut." I'd think most performers would enthusiastically agree.

All of this news isn’t only good for fans of the music: Wolfgang’s Vault is seeing to it that artists’ royalties are paid. Having triumphed in a lawsuit brought on early in the company’s existence by a number of record labels and artist managers who questioned Wolfgang’s right to post live recordings online, the company, says Sagan, is bending over backwards to operate above board.

This statement further adds to my feeling that they are innocent until proven guilty. They have no desire to get in a lawsuit.

Wasn't there one Newport set that was pulled, however? What was the story there?

I've mentioned this before but Dime regards anything from Wolfgang's as a "liberated boot" worthy of being seeded. I was told by a moderator that at least one well-known rocker regards them as thieves who don't pay anything, and so those Newport shows can be seeded on Dime with impunity.

It will definitely be interesting to see if Sue Mingus does anything. If she doesn't its almost a positive affirmation that all the i's are dotted and t's crossed, legal-wise.

So because one rocker doesn't like the vault, they regard "anything" there as a "liberated boot" and steal from the artists who might be paid. Assholes.

Anyone else agree or disagree? The 'Smoke' solo sure sounds like Dewey to me. Don't really a good enough knowledge of Eddie Daniels.

I can't remember. It was posted here somewhere. It wasn't one that I had on my radar screen.

FWIW, I've seen a few Rock shows appear on WV, only to disappear less than a week later.

The only specific one coming to mind is a couple Robert Plant solo shows from the early 80's (1983 I think) which I think were broadcasts from King Biscuit, but I know there have been others.
