Either way you push 11 CDs in excellent condition into the second hand market that will possibly be bought instead of new copies (as they're almost as good but cheaper), thus hurting the artists and the producer after all. And the copies you keep are definitely illegal. I don't consider the second-hand market a problem, in fact I like to browse and find things used (unfortunatley there aren't many places around to do that in anymore). Those items in the second hand market are all legitimate items, simply transferring ownership. Like cars, homes, and books, as Seeline suggested. The creation of digital copies and not keeping the item which allows you the license to do so is the problem - that's where the creators of music are losing out. -

I don't follow. If for example (btw. I am too lazy to do this myself) I trade in 30 CDs I never play anymore for a credit slip that allows me to buy 8 brand new CD's keep a copy on my hard drive, trade them back in within a week to get credit to buy 3 more new CD's I don't see how that is hurting the artist or producer. It seems like the only people its hurting is the record store by taking advantage of the policy they created. At any rate 11 new CD's got purchased within a week. If you kept digital copies of those cds that you traded back in, they are illegal copies. You don't own the right or license to keep that material without owning a legitimate CD or LP. The next person who buys one of the CDs you traded in has the legitimate copy that the artist was paid for. You have an EXTRA copy that has been brought into existence, and the artist didn't have any involvement or receive any credit for it. So two copies of the music exist, and only one had the money go where it was supposed to go - which equates to one lost sale. Does that make sense? -

Second hand discs (i.e. used) were originally purchased new by somebody. The royalties and money due to the producers were paid on the original purchase. I don't think royalties on second hand sales should be legal or even considered. edit - regarding Public Domain material - that's tricky, because the laws are different throughout the world. -

A used cd was originally new at one point. So when it was purchased, the artist and producer received the money they were entitled to. The fact that it is re-sold and re-purchased doesn't change the fact that it is one legitimate copy of a recording, and everyone received their entitlement. It's like a car or house being sold and re-purchased - General Motors or your home builder made their money on the original sale. If you make a digital copy of that item while you own it, that's within your rights. You are the person that is legally allowed that copy of that music. But once you sell it, you can't legally keep the copy. This in effect brings two copies of the music into existence (the original which you've passed on, and the copy which you are keeping), and the artist/producer has only been paid for one. It doesn't matter if the audio quality of the copy that you've made is different than the original CD. -

Never the less, he now only possesses illegal digital copies of music - save the ones he's kept on vinyl or cd. That's a lost sale for the artist/producer. -

The thing is, it's NOT junk at that point. The CD's are your legal license to possess the digital versions of the music. I know younger people consider it junk, but it's not. And I have no problem buying the used CDs that those people sell. It gives me the license to do what I want with them, that they have given up, regardless whether they possess MP3s of that music or not still. -
If that happens - and that's a BIG IF - it's more a testament to Clemens' friends in high places than it is a delineation between how people feel about Clemens versus how they feel about Bonds. If he and Bonds are both guilty, they both deserve punishment that fits their crime - in the court of public opinion, in Major League Baseball, and with respect to U.S. law (whether that's perjury or whatever).

Where have you heard this? Granted, the RIAA will try anything if the idea pops into their heads. AFAIK, making a copy of something you legally own is your right if it's for your own use. If you try to sell the original later, that's your business. Is there a legal precedent I'm not aware of? I believe the right to make/possess digitial copies of a recording transfers with the CD. Otherwise, in theory you could sell me a cd, i could burn a copy of it for myself, sell the cd back to you for the same price, and yet I now have a "legal" set of MP3's, and that's clearly not the case. -

There are a couple of vendors on the Amazon Marketplace who have it for less than $45, but not Newbury (theirs is $69). Thanks ! Except the cheaper sets aren't brand new. The Newbury set, like the other remaindered sets it's selling, is brand new and factory sealed, with a remainder mark through the bar code. Looks like I picked a bad week to ignore the fine print. -

Manu Ginobili was on fire at Cleveland tonight - 46 points, and 8 three pointers. Lebron had 39 pts, but the Spurs won, 112-105. Parker's been out for a while, and I"m not sure when he's coming back. Spurs don't seem like the team to beat in the West right now, regardless though. The Suns, Lakers, and now the Mavs have all made pretty significant trades of late.

Pettitte is admitting to additional HGH usage, this time in 2004. Looks like he's trying to come even more clean on the issue, for whatever it's worth. Pettitte admits using HGH in '04 WASHINGTON (AP) -- Andy Pettitte admitted using human growth hormone in 2004, saying it was supplied to him that time by his father, The Associated Press learned Wednesday. After the Mitchell Report was released, Pettitte said he used HGH for two days in 2002 while with the New York Yankees. Last week, the pitcher was asked to discuss drug use in both a deposition and affidavit before a congressional committee. "In that affidavit, Andy informed the committee that in addition to the two shots a day of HGH he took for two days in 2002, he also took HGH for a one-day period in 2004, shortly preceding season-ending elbow surgery," his lawyers, Jay Reisinger, Thomas Farrell and James Sharp, said in a statement. Pettitte pitched for his hometown Houston Astros from 2004-06 before rejoining the Yankees last year. Excused from testifying before a congressional committee focusing on Roger Clemens' alleged use of performance-enhancing drugs, Pettitte issued a statement through his lawyer minutes before the session began. "Andy had not previously mentioned this usage because he acquired the substance from his father, who had obtained it without Andy's knowledge in an effort to overcome his very serious health problems, which have included serious cardiac conditions," the statement said. "Andy did not want his father, whom he deeply respects and loves, to be brought into this matter and sought to shield him from publicity. In both cases, Andy used HGH in a misguided effort to recover from injury." The lawyers said Pettitte would speak with reporters when he arrives at spring training with the Yankees. Pitchers and catchers were due to report Thursday, but it was unclear whether Pettitte would be on time.
