I have not seen it. What's the scoop? -
Well, it wasn't by 12, but it was a win. A very ugly one, but a win nonetheless.

What kind of legal action can be taken? I would simply refrain from making generalizations and state your specific claims. Also please note if the seller offers a refund or not.

Man tries to hide guitar in pants...

Uhhh... that's nasty. -
Man tries to hide guitar in pants ASSOCIATED PRESS November 29, 2006 DE QUEEN, Ark. -- The guitar-shaped bulge in Morgan Conatser's clothing tipped off a music store owner that there might be a crime in progress. Clifton Lovell, owner of Guitars and Cadillacs on U.S. Highway 71 in De Queen, was talking with a customer last week when he saw Conatser, 29, walking out of the store. "I saw him walking out to his pickup truck and the bulges in his leather jacket. I said, 'Hey what have you got there,'" Clifton Lovell said. He said Conatser, 29, replied, "Nothing." Lovell pointed toward the unnatural shapes in Conatser's jacket and pants and said, "You've got something." Conatser then removed a solid body electric guitar from his pants leg and from underneath his jacket. "The neck of the guitar was almost down to his knee and the back of the guitar was almost up to his neck. It wasn't hard to spot. There was no way he could sit down or get into the pickup," Lovell said. With the guitar back in the store, Lovell didn't intend to call the sheriff's office. But then he discovered a wireless sound system was missing. Lovell called the Sevier County Sheriff's Department and gave a description of Conatser and his pickup. Deputy Jeff Wahls called Conatser's father, who told Wahls how to find the house. The deputy found Conatser at home, where Conatser went to his bedroom closet and retrieved the sound system, Wahls said. "He made a statement saying he needed the property because he needed to make ends meet," Wahls said. Conatser was arrested on a charge of theft of property under $500 for the sound equipment because the guitar had already been returned to the shop owner. The sound system was worth about $200. "This is a new one on me and I couldn't believe he tried," Lovell said. "The strings were pressed down and he didn't make any noise." Conatser was issued a misdemeanor citation and released. Conatser can resolve the charge by paying a fine or he can contest the charge in Sevier County District Court.

Wait wait wait... you're actually buying this stuff? -
Leave it to Microsoft to screw something up so radically. I dont think thats an issue, you need itunes for ipods. Yes, but Microsoft has been touting Windows Media Player as the defacto media player for upwards of what, 10 years now? And after all that, they release a music device that is not compatable with WM? That's just ridiculous, imo. And yes, they might just be releasing something to "get in the game" but why make it so laughably bad? Whatever happened to "do something right, else don't do it at all"? Why even bother?

Hey, money isn't everything. But it certainly helps!

I have to wonder about the person who would actually buy that.

What do you do after you're home from the gig?

These days I hobble into my house and take a fistful of pain killers so I can sleep. I am really looking forward to getting my back fixed. -
Big Ben and Skiles... who's gonna win that one? I think Ben got more than he bargained for when he left Detroit. He really should've stayed. Detroit is finally starting to figure out how to play without him and Nazr is playing really well (as is the rest of the starting five). Warriors taking down Utah and the Spurs is pretty impressive. Anyone else feel sorry for Iverson? I mean, he's always had shitty teams, but for some reason I really feel for him this year. The guy plays his ass off and gets nothing.

I had a hole in my eardrum as a kid that has since healed (I think). Here's hoping yours can be fixed as well. I used to get earaches as a kid seemingly every week. It sucked. I think that led to some of my hearing loss. What is interesting is the last time I was in the studio, I was hearing a high-pitched tone in the background of one of the tunes we were mixing. The engineer could not hear it, even under headphones, but I kept hearing it. We finally tracked it down to a bias problem on the tape machine, but he had to take the track into ProTools and slow it down, thereby reducing the frequency of the tone so that he could hear it. So I guess my high frequency hearing is still pretty good!
-
Do you have a cold? Mine is always worse when I have a cold. If you haven't been exposing your ears to high volume levels recently and the "background noise" is getting louder, that would be worrisome to me.
-
Yep. Amazing how much he accomplished in that short time and how he changed music.
-
I have tinnitus pretty bad. I have to sleep with a fan on or I have trouble sleeping because its fairly loud. Too many loud band rehearsals/concerts/performances etc. before using ear protection regularly. I use it now, that's for sure.

ELP covers (rips off) Big John Patton?
Jim Alfredson replied to Jim Alfredson's topic in Miscellaneous Music
Well, I already said in my initial post that perhaps it is the fault of the boxset producers, although I was under the impression that at least Emerson had serious input when it came to that set. As far as it being a rip-off, I seriously doubt the Patton and Green estates received any deserved royalties from the sale of the boxset because of the incorrect writing credits. So in that light, yeah, it's a rip-off. Back in 1993, when that set came out, Patton was still alive and active and I'm sure he could've used that money.
