  1. Yeah, no, not a Tyrone fan. I just grabbed it because I figured it was obscure and possibly even quite rare and I figured there were friends on the board who'd be interested to hear it.

From what I am reading third degree murder is for situations when you aren't targeting a specific person - like wanton disregard when driving drunk or discharging a gun and a bullet hits someone and kills them. So it might have been harder to get a conviction for 3rd degree. The family wants 1st degree but I think most would see that as a very heavy lift and a recipe for an acquital or hung jury. 2nd degree unintentional homicide makes sense - felony murder for you Law & Order fans. Keeping his knee on his neck constituted assault, the assault resulted in his death. Proving he intended to kill him is not easy. Heaven help us if Ellison overcharges or screws this up and the a-hole gets off or a hung jury.

It's pretty amusing that its the left, home of Hilary (Russia beat me, not Trump) Clinton and Stacey (I'm the Governor of Georgia) Abrams, are the ones who insist Trump won't leave office after he loses. Just because the left keeps saying it doesn't mean it will happen or even could happen. And part of the reason that it couldn't happen is that if Trump called out the army to keep him in the oval office, they would ignore his ineffectual orders. That would be the military that you think is close to being the tip of the spear that will turn us into a military dictatorship.

How long was Brazil a democracy before 1964 (serious question)? Also had the military intervened at any time in the past (also serious)? This is nothing but TDS on the level of "Trump will stay in office regardless of the election."

  8. I actually went with the Amazon seller account for the same guy and just got a shipping notification. We'll see how much of an obstacle the pond is for timely delivery.

  10. I decided to go with the Amazon listing, because the eBay listing from the same seller says he has 5 copies, 1 sold. I have to assume he's offering the same stock to both outlets so I think pretty good chance I see it by next month. And, easier to get a refund from Amazon if I am wrong.

  12. I am told by reliable people that there is a Black Lives Matter protest set for downtown Plant City tonight. But I am also told that local BLM activists are telling police that it ain't them, and they aren't us. Its expected to get a strong police presence, hopefully nothing bad happens. (They are supposed to be congregating right near a Tractor Supply which not only services the riding mower but also is my wife's go-to when she runs out of shavings for the barn or needs one more bale of hay to get to the weekend. Would be a shame if it gets trashed.)
  13. To get back to the subject of the post - the music - I probably wish I had grabbed this when it came out. Seems harder to find now, and strangely, eBay and Amazon lowest cost sellers are the same company, in the UK. And on Amazon has a 91% feedback which is way below minimum standards and is usually indicative of someone that claims to have stuff and then cancels because they never did; yet eBay seller is 98-99% feedback.

  15. In the case of the Messengers, would Art have had authority to cede to Swedish radio any and all uses? Seems that Dragon is doing things right as required by applicable laws in Sweden. But it seems like, if Blakey was under contract with Blue Note, that Blue Note or its then-current corporate masters could have asserted rights when a live recording of the group got released. Same potentially with Columbia and Miles though it sounds like they took care of it by just issuing it themselves? What was Dragon's rights versus Columbia's?
  16. I saw the many studio recordings by Swedish artists on the Discogs page. So are you saying that the music was properly licensed from Swedish Radio back in the 80s when these recordings were first released? Or that the artists came and performed, and were compensated for not only the broadcast but future releases of the recordings? Wouldn't that have violated the rights of, for one example, Blue Note Records, for the Messengers releases? There are two interests involved, owners of the recordings and the artists recorded.
  17. Longevity in the marketplace doesn't mean anything. And how is it that you know they have legitimate rights to all those live recordings by Miles, Sonny, Jazz Messengers etc etc? They started putting them out in the 80s long before there could be any claim to being PD.

  19. Well this is a pretty ironic example of the "everybody will discover they own at least one track" BFT rule. Who would guess I own that Tyrone Washington album? And the only reason I bought it was that I recognized the name and thought some Big O friends would want to hear it. The copy I picked up was still sealed and about $3 IIRC. I know I sent a copy to Lon and I want to say I sent it to Sangrey too? Though I wouldn't be surprised if he got his own at some point. I think maybe I sent to Rooster too? I just recall making multiple xeroxes when I had it in hand.
  20. Interesting that Ray had producer credit. Granz was very much involved - according to Janie Harris' bio, he said to Gene on the first day of recording, "I don't want any of that Three Sounds shit on this album!" The record is also important because it led to Gene joining the Ray Brown Trio, and the excellent second act he had as an international performer.
  21. Speaking of sharing the roadway, out here we use SR 60 to head toward most of civilization. Its a divided highway, two lanes in each direction, but not true "limited access" highway, there are streets off of it and driveways too. But 65 speed limit and ... a bike lane. Can you imagine pedaling with people driving 70 around you? In 4+ years I have never once seen a cyclist using the bike lane.
  22. This is definitely the first I've heard of IRS plastic. (I got my payment to the checking account where we've had previous refunds sent - I got the money quite early in the process. A friend ended up finding out that his $$ went to an old account but that got fixed pretty quickly actually. Money is fungible and all but cards wouldn't be very helpful for people using the stimulus payment for rent.
  23. How did he miss the fact that, to start with, its not a jazz solo at all? I mean the ignorance starts with the internet hearing a horn play one note over and over and declare it to be the "worst jazz solo ever". It may come straight out of Jacquet but by 1956 it was R&B from start to finish.

  25. I gave in to temptation a couple of days ago and placed a discogs order with a dealer offering $5 shipping for 4+ records. But knowing how bad Media Mail has been I asked for a Priority Mail option and he offered $10. Scheduled for delivery by Monday, showed up this afternoon.
