  9. Most (if not all) of the masters are owned by the leaders of the dates. Many of the issued cds are legally questionable. I know Mary Ellen Rouse (Charlie's widow) had to hire a lawyer to get her masters back and stop the marketing of the cd. I believe the date with Bartz, Hancock, etc was a Black Lion recording currently owned by DA Music. Clifford Jordan owned his masters and all the stuff in the "Dolphy Series" - Cecil Payne, Charles Brackeen, etc. I believe he sold the Sanders master to Arista (or someone). I know this 'cause he offered the lot to me. This is a mess, never to be really resolved.

  13. Having been part of negotiations with dozens of musicians concerning broadcasts of performances, I can say most were concerned with the future dispersal of the material and some declined. The contracts specified a one time broadcast and copyright protections. You are free to interpret the wishes of the artists and parse these against your interpretation of the legalities. Folks mentioned above include McCoy Tyner, Max Roach, Stanley Turrentine, Freddie Hubbard, Earl Hines, Benny Carter, Benny Goodman, Herbie Hancock, Miles Davis, Anthony Braxton , Art Hodes, Sarah Vaughan, Lester Bowie, Cecil Taylor, Bud Freeman, Betty Carter, Jimmy Smith, Steve Lacy, Ahmad Jamal, Dizzy Gillespie, etc. I think you get the idea.

Most of the problem is a series of laws giving "property rights" more power than "intellectual rights", and a segment of the population sees this as a "window of opportunity" to take what they want.* There are creeps in every crowd, I just hope the crowd doesn't continue to grow as it has in the last 15 years. * the root of the property vs intellectual struggle is it's the property guys with the bulk of the bucks, thus political power. This exists everywhere.
