Jim, The MLK library in DC had a copy of My People (Soul People) a few years back. I borrowed it a few times but never got around to listening to it. A quick search of their on-line catalog seems to show it is gone, which doesn't surprise me in the least as most of their LPs were stolen. A few of us tried to warn them that people were trying to sell LPs in their collection to used book stores, but they didn't seem to give a fuck. Next time I'm there, I will try to see if they have it. Some of their LPs were never cataloged. Cross your fingers... Bertrand.

Idiot that I am, I thought that copy protection mean you couldn't burn copies of the CDs, not that you couldn't upload them to a PC. That sucks even more. 1. Blue Note: well, Blue Note U.S. isn't doing it so I'll just forget about that (I was going to send my letter to MC so he could forward it to the people at EMI, but since EMI U.S. has nothing to do with it, forget it). I'm sorry for our European friends. 2. Other labels: what jazz labels are using copy protection in the U.S. Did we decide that Jimmy Smith Verve (The Boss, I think) was protected? What other Verve titles are protected? I have Snap Your Fingers, 'S Make It, Gloria Coleman and Billy Mitchell in this series. Are the protected? (I think I played the Coleman on my PC). Is it written on the CD case? Any other jazz labels doing this? If it's not written on the back, and it can't play on a PC, then it's defective. Thanks, Bertrand.

It has come to my attention (thanks to tonym) that European copy-protected RVGs cannot be uploaded to iPods, at least not through iTunes. Apparently, this can only be done with some complicated software. Has anyone else experienced this? I have yet to buy any copy-protected CDs (that I know of), so I have not had to face this problem. I do remember a past thread where people were not able to play a Jimmy Smith Verve reissue on their computers. Since no other titles were mentioned, I thought this might be a fluke related to just this one title. So my questions are: 1. Are there other copy-protected Verves that can't be played on a PC? 2. Can these titles be uploaded to iPods? 3. Have others experienced the same problem as tonym in uploading European copy-protected RVGs to iPods? If the answer is yes to 3 , I will start an open letter to Blue Note in another thread. Once I get enough signatures, I will send this to Michael Cuscuna (and later, some Jazz mags) to complain, and ask him to forward this letter to the bigwigs at Blue Note/EMI. If the answer to 1 and 2 is yes, I'll also send it to Verve. Apple will not be too thrilled either. It's not like these titles could be re-purchased through iTunes. Most Blue Note CDs only have some tracks available. Bottom line: PCs and iPods are legal means of playback with the same status as regular CD players. Their product should play on these media with no problems. If not. their products are defective and should be returned. If anything, this will encourage stealing. For example, a dishonest person would send tonym a burn of the U.S. CD so he can upload it to his iPod. The copy protection will just encourage such illegal activity, which of course no one here on this forum condones. Bertrand.

Aha - you say that 'Night Flower' and 'Alone And I' are similar/the same? I'll check. The McMaster Free Form had 'Night Flower' listed as composed by Byrd on the back cover (liner notes had Hancock). As for the iPod issue, I will start a separate thread in reissues. Bertrand.

tonym, Why is it you can't put this session on your iPod? Is it because you haven't figured out how to upload CDs into your iPod in general, or is it because of copy protection? If it's the latter, I will start an open letter to Blue Note in another forum which I will send to Michael Cuscuna. If copy protection prevents CDs from being uploaded to iPods, that is totally unacceptable. If anything, it will encourage stealing. The iPod is a playback medium, just like a CD player. One should be able to upload any CD to it. Bertrand.

Jim, Remember that the Shorter is the one my mother brought in. It works OK, but Orgasm is a much better record. Notice how Shorter himself actually solos very little on Tes Esat? Bertrand.

Jazz artists should go the Allman Brothers route and just make a CD of each concert available for sale right after the show. Bertrand.

They get away with this crap by making the claim that they are the first, and hoping that no one will challenge them. With resources such as on-line or CD-ROM discographies now available (flawed as they may be), they may no longer be able to pull this off. It's not too late to set the gullible public straight for the Don Quixote thing, perhaps through a letter to the NYT? Isn't Todd Barkan the one who should do this research (or farm it out)? Update: called and left a message. I now have her e-mail (didn't have it earlier today) thanks to our mutual friend who sent us a mass e-mail and doesn't know about sending mass e-mails using the bcc option. Bertrand.

I edited my two postings to further clear up a misunderstanding that seems to have arisen based on some of the repsonses. Thanks to everyone for their ideas - some of you exactly understood my dilemma. I'll go ahead and call in a bit when I'm done with work. For now, I'll leave it as a phone call. I wouldn't have time to get together for a while anyway. If it comes up, I will make it clear that there are some people I just don't care to speak to anymore. Bertrand.

Thanks for all your replies so far. I'm still doing a lot of thinking, but I haven't had time to sort through all the postings yet. But I did want to bring up a couple of things: 1. Dan seemed to imply that it was inappropriate for me to post this here. This was partially based on my allusion to a personal problem. This problem does not have any direct bearing on the matter at hand. I just brought it up to say that I had a lot on my mind right now, and this new matter was just not coming at the right time. Now one more thing has come up, so I have even more on my mind! 2. Some of you seem to think there is some romantic issue involved here; that is not the case at all. She is only calling because my name came up when someone else was planning a sort of mini-reunion, and she had the reaction: 'oh wow, I haven't spoken to Bertrand in years. I wonder how he's doing'. There was never anything romantic between us. Both of us are very married with kids. 3. I think my main worry is that I don't want this to lead into having to get together with some people I don't want to see again. If I can just catch up with her, then that's fine. If I decide we have nothing in common, then I'll just let it go. I'll check in later. Thanks again, Bertrand.

I nearly dropped dead of a heart attack on Monday. I get to work and there are eight, count 'em eight voice mails waiting for me. Six are from clueless co-workers who have no idea how to fix a trivial non-problem (I wasted a whole day in e-mails and conference calls), and two are from old acquaintances from high school. The guy I see every few years although I'm bad about keeping in touch; I always liked him. I didn't have time to call him back yet, but he called tonight and we chatted for a long time. The other call was from a woman I've known since I was 5 or 6. We went through the French School in D.C. together for like 12-13 years. Then, when she moved to Paris after College and I was living there as well, we used to hang out a lot (jazz gigs and movies mostly). We were always just friends. Anyway, we haven't spoken since her wedding in 1990, so getting the call sure was a shocker. I haven't had time to call her back yet, but I'm a bit hesitant. Truth is, I was unhappy at that school. For a while, I was hanging out with the people from my class who live in D.C., but I really felt uncomfortable with that crowd. Among other things, they liked to put down my job (I'm a government grunt) which after a while really started pissing me off. Also, they would always nag me about when we were going to have kids, which was really none of their effing business. Anyway, I don't know if I should call this woman back. It's been so long, and I'm worried that I'll start a chain reaction and have to start socializing again with the crowd I'm trying to avoid. Plus, she apparently has some high level job somewhere - I can see another scenario where I'll feel kind of inferior. I guess the problem is I just have so much shit going on in my life right now (including some personal problems I'd rather not get into) that I just don't feel like I'm best equipped to handle this right now. I'm not really sure why I'm so upset about it, but I just can't seem to focus. Any ideas? Bertrand.

I posted my opinion of the crummy job they did with the George Russell - they fucked up the separation between tunes. For $10, that's a scam. I know I could probably mess around with iTunes for 2-3 hours and fix it, but I just don't have time. Teach me to be honest. I should have just burned a copy off a friend. I guess I got hoodwinked by the 'don't steal music' sticker on my iPod when I bought it. Bertrand.

Mike, Butch Warren is still living, although keeping a low profile right here in D.C. I've been periodically posting about this in the live shows forum. I haven't seen him in a few months. He lost the Wednesday night gig because he was unpredictable ('hasn't been taking his medicine'). I'm trying to put together some sort of benefit/tribute (don't tell Allen Lowe), but I have no clue how to go about it, and I can't pay anyone from my own pocket. Bertrand. -
