  1. I've noticed fluctuations in the price on various non-music items in the save for later section of my shopping cart from time to time. I doubt it's the result of manipulation but instead, a reflection of fluctuations in the cost of the items. If a distributor raises the cost, Amazon would understandably increase the price. My experience has been that prices drop as much, if not more, than they increase.

  4. So much pain, so much sorrow, so much drama. Such is the life of many who regularly post on the eMusic board. While there's certainly a good amount of unnecessary stress and confusion in dealing with this new format, I find the nastiness and histrionics of some members rather laughable. For some reason, I've encountered few of the problems others report, and I've had no difficulty downloading files or saving titles to my list.
  5. Doh! I finally appreciate what you've been saying all along, Jim. If this music is now in the public domain, it should be just that - public, i.e., free. In most cases, Jordi and his ilk contribute nothing substantial, i.e., improved remasterings, restored original artwork, etc. All they are doing is making money off of that which already belongs to us. It really is quite ludicrous to pay for what they are selling.
  6. Have these tracks appeared on other CDs or download services meanwhile? To answer my own question, these two tracks (and "All I Want") are featured on a third disc included with the Japanese limited edition of Then And Now: The Definitive Herbie Hancock. Since the Japanese edition of River already includes A Case of You, the Japanese get to buy all four of the bonus tracks on CD. Of course the whole thing is a major rip-off... Most of what Herbie has released in recent years is a rip-off.

Depending on how one reads it, one could ask the same question of you. I don't know your intentions, so I don't assume there's anything underhanded about your comments.

  9. Still wondering --- what's the beef against "this cat"? Peter launched a one-man campaign against Jazz Loft here in 2009 when he didn't receive his order in a timely manner. No one agreed with his negative view of JL, and so he used the board to publicly call out the owner, who was/is also a board member. It was a sad and seemly affair, one that I would have hoped Peter had gotten over by now. Read it here

  11. You conveniently ignore the fact that it is Fresh Sound's own distribution company, Absolute, that makes these titles available to U.S. retailers. That doesn't excuse retailers from their role in the process, but it doesn't make Jordi an innocent bystander either. As Jim said, if you're going to steal, then do it. Don't call it something else, or justify it by blaming it on someone else's actions or lack of action. We're talking about records here, not medicine or a loaf of bread. There's no ethical conundrum at play, just people's desire to obtain something that the owner doesn't wish to sell.
  12. Imo, this reads more like a press release than a journalistic endeavor to inform and clarify. First off, let's establish the fact that the legal owners of copyrighted material are bad, greedy, or just ignorant people. Then let's spoon feed Pujol a series of softball questions ("So issuing these recordings isn't bootlegging?"), and never challenge or ask for clarification of his answers. How about something like, "So, if it's legal to sell these recordings in Spain and other parts to Europe, why do you sell them in the U.S. where they are protected by copyright?" Pujol cites the source of FS's releases are "a large warehouse of reel-to-reel tapes that we bought from many different record labels in the 1980s". When asked how he could have purchased these copyrighted titles, Pujol says, "I assume these recordings were not protected under the U.S. copyright law". Curiously , he seemingly contradicts himself by adding, "You should know that we never bought them." So, you assume they were legal to sell, and so you purchased them, but you never bought them. Pujol also asserts that "Many people believe that all labels coming from Andorra or Spain are related to FS. This is simply not true." So tell me then, what website advertises the Andorran labels' titles, as well as those from Fresh Sound? Answer: Blue Sounds, owned by Cristina Pujol Masdeu. And who distributes the physical product? Why, it's Absolute Distribution, whose parent company is Blue Moon Producciones Discograficas SL, a division of...drum roll, please...Fresh Sound Records. I'm not saying that some of Pujol's efforts aren't noteworthy. Specifically, I'm thinking of the new recordings released on the Fresh Sound New Talent label, many of which I enjoy very much. However, I'm not buying this guy's Robin Hood act, and the bias and obvious holes in this "article" only serve to reinforce my opinion of him.
