  1. I’ve purchased LPs from Import CDs. They were very well packed. No damage.
  2. Whether or not claims set forth on a lawsuit are actionable remains to be seen. Notwithstanding whether is a basis for these lawsuits, many lawsuits have been filed (and will be continued to be filed).
  3. Sadly. My son thinks it’s better to close shop and wait until 2021 whereas my attitude that it’s better than nothing. This Covid problem is going to be with us next year and there is no assurance that a full season can be played. Anything they can learn this year about dealing with Covid can only be helpful. The current agreement expires at the end of 2021 and given the level of distrust (the players think they gave away too much during the last negotiations), a work stoppage seems likely.
  4. NJ is fully opening tomorrow so we will see what’s what.

The long and short of it is that negotiations have broken down and since MLB has the right to impose a 48 game season unilaterally, the Players Association has requested they do that and advise them where and when the players should report. MLBPA rejects latest proposal, tells MLB to schedule the season
  6. Our favorite Chinese restaurant finally re-opened on Friday, but for takeout only. They have a plexiglass sheet in the entrance (after you walk through the door) with only openings for exchanging credit cards and food.

  11. Since they don’t care, the campaign doesn’t really need the release as the people going are willingly assuming the risk. I’m sure some will sue anyway.
  12. Sorry, meant to delete the last post but you were too quick! At any rate, in non contract situations local law generally applies.
  13. It’s not a question of jurisdiction. If an artist violates his contract and an American label seeks to enforce it in a non US court, and if there is reciprocity between the two countries, speaking generally, the non US court will allow the label to pursue the matter. In addition, if the contract specifies that in the event US law applies, the court will examine the applicable US law to determine the matter. Reciprocity works both ways. A non US plaintiff can bring suits in US courts.
  14. Without reviewing an agreement, hard to know what its contours are. However, even assuming that a contact governed by US law granted all rights, both US and international, to a label, the practical question is enforceability, i.e., is it worth hiring lawyers to bring a lawsuit, especially when we’re probably not talking huge sums of money. Maybe a different story though if we’re talking about some big rock group.
  15. This liability waiver has raised a lot of controversy, probably because it relates to the president, but his campaign is by no means the only organization asking for one. See Businesses Want Virus Legal Protection. Workers Are Worried If I’m an employer, I definitely would want these protections, an employee not so much. Notwithstanding whether you have these protections in place, when people go out in public, whether to a gym, salon or restaurant, you are assuming the risk that you may get the virus. If an employer or other business has used reasonable precautions to keep the area cleaned, they should be immune from lawsuits. We are a litigious society so that doesn’t prevent anyone from bringing a lawsuit if they wish to do so and I’m sure defendants will raise the assumption of the risk defense. As respects the employer employee relationship, many states (Including NY and NJ) follow the employment at will doctrine, which means you can be fired for any reason or no reason. If any employee refuses to sign a waiver they could, at the employer’s discretion, be terminated. This is an issue that is not going away.

  18. I had an appointment with my cardiologist last week and you had to wait in the car until they were ready for you and once you were finished, you left by an exit separate from the entrance so you wouldn’t cross paths with anyone else. You had to call to make a follow up appointment.

It’s the groundbreaking book on historical memory. Sometimes how we remember an historical event is almost as important as the event itself. David Blight is also the author of the definitive work on Frederick Douglass, another great book.
  21. I’ve had a few records shipped to me via media mail recently and (at least here in NJ) they have arrived quickly. The bottlenecks plaguing the system seem to have been corrected.
