'Day of mourning' for stunned Pats fans By Peter Schworm, Globe Staff | February 5, 2008 Adam Marchand sat alone on a park bench in Copley Square yesterday, somberly staring straight ahead. He had no book, no newspaper, no cellphone, no iPod. Just painful memories of the agonizing New England Patriots loss in Sunday's Super Bowl and thoughts of what might have been. "This is a day of mourning," said Marchand, a 29-year-old hotel worker from the Back Bay. "I didn't want to even get up today. I still can't believe it." Marchand had taken the day off in anticipation of a late-night celebration to mark an undefeated season and the team's fourth Super Bowl championship. Instead, he and countless other heartbroken Boston fans spent the day in a state of disbelief, struggling to make sense of a soul-crushing defeat that few saw coming or even imagined possible. Losing in the final seconds, just one win shy of perfection, was the cruelest twist, they said. "They had a chance to make history," he lamented. "The undefeated season, gone. It doesn't mean anything anymore." From the South End through the Back Bay to City Plaza, diehard Patriots fans shuffled in a half-trance down streets they had expected to dance in during a victory parade planned for today. In a sports-crazed city whose spirit is inextricably bound to the fate of local teams, the mood was decidedly morose, the sense of loss genuine. "You can hear a pin drop," Samantha King said as she walked across Boston Common. Like Marchand, King had taken the day off, expecting Sunday night to stretch far into Monday morning. Instead, the Super Bowl party broke up early, and the 31-year-old spent the day shopping for shoes. Patriots garb, omnipresent in recent days, was rarely seen. On a bleak, gray day that matched the mindset of many people, the city felt slower, sadder. Smiles were scarce, mutters the main form of conversation. Many boycotted all sports coverage, and some could not even bring themselves to discuss the game. Too soon, they said. "I really don't want to talk about it," said Sean Savignano, a 21, a courier from Dorchester. "I'm really bummed." New England sports fans have known plenty of heartache. But in recent years, with the Red Sox and Patriots winning an incredible five titles between them without a single championship defeat, once-fatalistic fans had come to expect the best. Surely the unbeaten and heavily favored Patriots would not break the streak. When they did, spoiling a perfect season and the claim to be the greatest team of all time, many fans felt sucker-punched. This loss was not supposed to happen. This loss would linger and leave a mark. "It's a hard [expletive] blow; that's for sure," said Ray Thibault, 19, of Boston. "19-0, I was sure of it. I still can't believe it. Man." Standing on Boylston Street, Thibault could almost picture the throngs of delirious fans as his conquering heroes rolled by on Duck Boats. He would have been right there with them, he said wistfully, whooping until his voice went hoarse. The shocking upset cut wide, from laborers in hard hats who ate lunch together in grim silence, to downtown business types who vented about the game during cigarette breaks. And to a fan, it cut deep. "I'm absolutely devastated," admitted Douglas Cooper, 25, from Andover on his lunch break. "We had it, the perfect season, and it all fell apart. It's totally depressing." Jose Pina, 35, from Roxbury, woke up feeling blue, and put on Red Sox garb, as a form of solace. It didn't work. "We should have had that game," he said near Copley Square. "They broke my heart. They broke everyone's heart. Everyone is down today." Like many fans, Pina leaned on previously won titles to soothe his wounded psyche. "We're still a dynasty," he said. "We're still the city of champions. I'll be OK." Some found kinship in the shared suffering. "I've been walking around looking at all the sad faces," said John Yelmokas, 68, from Braintree. "Everything seems dead today." Some observers shook their head at all the moping. Buck up, they said. It's just a game. "They had 18 wins, but people still complain," said Joe Santo, a newspaper vendor in Copley Square. "They love to complain. They want to relive the pain. They can't let it go." Brockton resident Karen Mathis also had little patience for self-pity. On her morning train ride into Boston, Mathis said she did not see a single person smile. "They're just sulking," said Mathis, 50. "They'll get over it." On the Common, a woman in her 20s wearing a blue Patriots cap looked downcast and somewhat lost. Asked about the game, she bristled. "I really don't want to talk about it," she said. "Sorry." When a light turned green at an intersection, she hesitated, unsure where to go. Finally, she strolled into the Public Garden. Note: I'm placing the city of Boston on suicide watch. Britney will have to look after herself in the mean time.

Thelonious Monk - New Sony Columbia CD reissues
robviti replied to monkboughtlunch's topic in Re-issues
you guys really think they'd remaster monk and issue it for $5.99? it's pretty obvious to me that sony is putting out some of monk's music for the budget crowd. these are the cds you see in large bins at walmart, fye, at convenience stores, etc. he'll be sitting there right next to mariah carey's mtv unplugged, leslie west's mountain, and tammy wynette's stand by your man. these are all titles on this budget label. of course, he'll also get to share space with al dimeola, ahmad jamal, and even wynton! here's a link to a list of these "jazz bargains": sony special market releases p.s. and don't be surprised if some of these cds have tracks missing. think about the market they're targeting. these ain't intended for us! -

I'm not sure how many of you appreciate guitarist joe diorio's music. he's had a long but relatively obscure career, and imho he's much better than metheny. anyway, i'm trying to locate a copy of his 2005 trio release it's about time. joe might have released it himself, which could help explain why i can't find it anywhere. also, if anybody has any up-to-date contact info for joe, i'd be happy to buy it from him directly. thanks in advance for any and all help. p.s. in case you haven't heard joe or this particular recording, here are some 2-minute clips of all the tracks: diorio - it's about time

Court: Spears' Dad Has Temporary Control Feb. 1, 2008, 9:54 PM EST The Associated Press LOS ANGELES (AP) -- Throughout the course of Britney Spears' months-long emotional tailspin, one universal question has lingered with each spectacular turn: Why doesn't her family take drastic measures to stop this? On Friday, they did. Spears' father, James Spears, was put in charge of the troubled pop star's welfare during a surprise court appearance by him and mother Lynne Spears, a day after their daughter was whisked to a hospital for a psychiatric evaluation. Just as Spears' immediate family was taking charge of her life, Sam Lutfi, the man seen escorting her about town and sometimes speaking on her behalf, was removed from the picture with a restraining order. A message left on Lutfi's cell phone seeking comment was not immediately returned. James Spears' eyes grew teary when he was named conservator of his daughter. He and an attorney, Andrew Wallet, were named conservators of the estate. The parents sat with attorney Blair Berk throughout the hearing, smiling and embracing after the announcement. The events of the past two days were the first positive signs that Spears may have reached a turning point in a downward spiral of bizarre behavior — all of it captured by paparazzi lenses — that has resulted in her losing custody of and visitation rights with her two young sons. Spears was taken early Thursday by paramedics with a heavy police escort to UCLA Medical Center's psychiatric hospital. There was no account or description of the young star's actual condition during the hearing. It was the second hospitalization this year for the 26-year-old singer, who has exhibited odd behavior since November 2006, when she filed for divorce from Kevin Federline, the father of their sons, 1-year-old Jayden James and 2-year-old Sean Preston. A court creates conservatorships when it determines that a person cannot care for themselves or handle their affairs. Commissioner Reva Goetz said Spears would be under conservatorship until Monday, at which time another hearing would be held. "It is in the best interests of the conservatee to have conservatorship over her person," Goetz told a packed courtroom. As conservator, her father will have the power to "restrict visitors," have around-the-clock security for Spears and have access to all medical records, Goetz said. It was unclear whether the court gave her father the power to make medical decisions on Spears' behalf; even if that was granted, the role can be limited. Conservators can consult with doctors on medication options, but the patient can refuse. Only in emergencies can someone be forcefully treated. Otherwise, a court hearing must be scheduled to hammer out the issue. "Being a conservator does not give them the power to force medication," said Nancy Kincaid, a spokeswoman with the California Department of Mental Health. The court also issued a restraining order against Lutfi, Spears' sometime manager and friend, and gave her father permission to change the locks on her estate and remove anyone who is there. Goetz said conservatorship over the estate was "necessary and appropriate." She gave approval for the conservator to "take all actions to secure all liquid assets including credit cards." Dr. Mark Goulston, a Los Angeles psychiatrist who is not involved in the case, said he was not surprised by the ruling, given Spears' increasingly erratic behavior and what appear to have been periodic and unsuccessful efforts at rehabilitation. Although placing people in conservatorships is not unusual, Goulston said, courts usually look long and hard at the evidence before putting a person in one. "You have to really make a case before someone is allowed to become a conservator, so I would conclude her judgment is fairly impaired," he said. The court, which rejected a request to hold the hearing without news media present, did not immediately rule on another request to seal all documents. Goetz said she would rule on Monday, and court spokesman Allan Parachini said the papers would remain sealed until then. The conservatorship was approved by a different court from the one handling a custody dispute over the singer's children with Federline. A hearing on custody issues is set Monday morning in that court.

jazz heritage is a mail order music club operated by the music heritage society. as such, it reissues titles originally released on other labels. the third date included in the lonehill compilation is tonight - clark terry/bob brookmeyer quintet, which like the other two titles (gingerbread, the power of positive swinging) was released by mainstream.

US sales tax (for US customers)
robviti replied to The Magnificent Goldberg's topic in Miscellaneous - Non-Political
what inconsistent about the system? like chris said, you pay a sales tax if the company you're buying from has a physical presence in the state where you live. i guess the logic behind this is that if the company benefits from various state services (police and fire departments, water and transportation systems, etc.), they should bear some of the burden of paying for these services. the only exceptions to this rule are if you live in a state that has no state sales tax (Alaska, Delaware, Montana, New Hampshire, and Oregon), or if you qualify for tax-exempt status (religious and charitable organizations, etc.). come to think of it, holy sister jazzshrink has a nice ring to it, doesn't it? -

Frank Kimbrough on the radio today and 1/22
robviti replied to ghost of miles's topic in Jazz Radio & Podcasts
for anyone that's interested, frank's performance at wgbh last night was simply beautiful. it's not often that you get the chance to hear a great artist like frank playing a beautiful, responsive instrument in an environment specifically designed for this kind of experience. it was a real treat to witness this live broadcast first-hand, and i hope those who were listening on the radio enjoyed it as well. i've enjoyed frank's playing in a number of settings over the years, i.e., maria schneider's orchestra, the herbie nichols project, his trio, and his duos with joe locke. to hear him in a solo setting is something else, though. someone asked him why it took so long to release a solo recording*, and why there aren't that many solo jazz piano releases. sure, there are popularity and business factors to consider in recording solo. i think it also might have something to do with the sheer intensity and the artistic vulnerability of solo performance. it just might be too much for some listeners, and possibly too much for some musicians as well. regardless, i want to thank frank for an unforgettable experience, and also thank my friend stevebop for making it all possible. you guys are great! * frank's new solo recoding air is only available from the palmetto records website (cd and mp3). i recommend it highly. here's the link: air -
Someone's been watching too much TV. not really. when my office was broken into a few years ago, they attempted to steal my executive stereo, but left it at the back door (beating a hasty retreat, ADHD, i dunno). the detectives dusted it for prints, got some good ones, and took the stereo as evidence pending analysis of the prints. that's the good news. the bad news is it took me several months to get my stereo back from the police, and that was through another therapist who had friends on the job. funny thing is, they still hadn't received the results from the crime lab! oh yeah, and the stereo was covered with the black dust from the fingerprinting!

sorry dan, but i think that is bad and possibly dangerous advice. joe, i'm really sorry about what you're going through. keep in mind that if you own and train a dog for the purposes we've discussed, you could face a serious legal liability under some circumstances. i'm not saying you shouldn't get one, just check it out beforehand. for now and at the very least, you might want to go to the store (hardware?) and get some "this property is protected by the "acme" security company" stickers to put on the windows. it's cheap, and it's a deterrent for some thieves. it's quite possible that this was the same thief as before, since repeat break-ins are fairly common. it's also very likely that he's broken into other houses in your area as well. perhaps you and some other victims could get together with the community police officer and come up with some ways to deter/catch this guy. i hope it's just a (short) matter of time before the police arrest the guy. good luck.

sorry, but i don't own this recording. but your remark about it's "not all tommy" prompted an interesting search that has left me with a few nagging questions: 1) did our chris a. ever go back to his copy and confirm what he heard from others? 2) has scott yanow ever confirmed or denied this rumor, since he wrote the liner notes for the release? 3) what does our own ken dryden have to say about all this, what with his review of the release being featured on amg? inquiring minds (with little else to do) want to know! -
